General Terms & Conditions
The sale on the website www.moltonbrown.it managed by beauty San Spa of "Molton Brown" branded products and owned by the company Molten Brown Limited is governed by these General Conditions which must be considered an integral and substantial part of the sales contract. The Customer is therefore invited, before sending the order, to carefully read the conditions of sale as identified above and the information contained therein and to print them or save them on another durable medium accessible to him.
Any changes or new conditions of sale will be promptly reported to the Customer, will be effective from the moment of publication on the site and will be applied only to sales concluded after publication.
Sending the order by the Customer constitutes acceptance of the conditions of sale in force at that time.
Art. 1 General Provisions
These general sales provisions are applicable to all sales of “Molton Brown” products concluded remotely remotely through the website www.moltonbrown.it.
The use of the distance selling service described in these General Conditions is reserved exclusively for consumers (hereinafter, "Customers" or "Customer"), understood as natural persons acting for purposes unrelated to their commercial, artisanal or entrepreneurial activity. or any professional activity carried out, over 18 years of age (or, if minors, authorized by their legal representative).
The language available to conclude the contract through the Site is Italian.
The Customer is required to carefully read the General Conditions that have been made available to him on the Site, in order to allow their knowledge as well as their storage and reproduction by the Customer pursuant to article 12, paragraph 3, of Legislative Decree 9 April 2003, n. 70 (“Implementation of Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce” - hereinafter, “Ecommerce Decree”). The contracts concluded with Beauty San SpA through the Site are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 (hereinafter, “Consumer Code”) and by the Ecommerce Decree.
The seller is Beauty San SpA, with registered office in Viale Giovanni Milton, 27 - 50129 Florence - Italy, VAT number and tax code 04604720484, REA FI – 464680 – operational headquarters Via Rimini,37 -59100 Prato.
Before sending an order proposal, Customers are invited to ensure that they have read and understood the instructions provided during the purchase procedure and these General Conditions, as they will be binding once the contract is concluded.
Art. 2 - Conclusion of the Contract
The order sent by the Customer to Beauty San SpA must be completed in its entirety and must contain the elements necessary for the identification of the Customer and the products ordered as well as the indication of the place of delivery, under penalty of its nullity. Beauty San SpA will send the Customer, via email, a confirmation of order receipt, containing a reference to the applicable conditions of sale. In compliance with the provisions of article 53 of the Consumer Code, upon confirmation of the order or execution of the contract Beauty San SpA will send the Customer, by e-mail, a summary of the General Conditions, the information relating to the essential characteristics of the Products purchased, detailed indication of the price and means of payment, information on delivery costs, information on the conditions and methods of exercising the right of withdrawal, the geographical address of Beauty San SpA in where you can submit complaints, information on assistance services and existing commercial guarantees. The Customer must immediately verify the content of the communication and immediately report any errors or omissions to Beauty San SpA. Without prejudice to the uses of the data described in the Privacy Policy and subject to the express consent of the Customer, the form with the order proposal and the Customer's data relating to the order proposal will be maintained by Beauty San SpA for the period of time required by current legislation.
Art. 3 – Availability & Delivery
Beauty San SpA undertakes to accept orders within the limits of available goods stocks. In particular circumstances, Beauty San SpA may not be able to ensure the availability of all the products offered and cannot therefore be held responsible for the temporary unavailability of one or more products.
The sending of the order by the Customer also constitutes acceptance of a possible partial delivery, limited to the products available within those ordered, as well as a waiver of requesting compensation and/or compensation for this purpose. Beauty San SpA also undertakes, in accordance with the law, to promptly inform the Customer of any unavailability of the ordered product.
If despite our vigilance, upon payment confirmation the product is temporarily unavailable, Beauty San SpA reserves the right to offer a replacement item of equivalent quality and price, without charging additional costs to the customer. If this is not possible, or if the customer does not want replacements, he can decide whether to wait for new availability or cancel the order, always without additional costs.
However, in the event of permanent unavailability, if it is not possible to supply an item of equivalent quality and price, the order will be automatically canceled and the customer will be refunded immediately.
Beauty San SpA delivers the product or products ordered by the Customer, in accordance with the provisions of the art. 5 and under the conditions expressly indicated in the section of this site called " Our Services ".
Art. 4 – Prices and Payment Methods
The prices indicated on www.moltonbrown.it are in euros and include VAT.
Transport costs are excluded and are highlighted separately if due.
The prices applied are those indicated on the site at the time of the order by the Customer. The prices of individual products are subject to change and, therefore, the prices indicated from time to time on the site cancel and replace those previously indicated. The price of the products purchased, together with the possible cost of home delivery, must be paid by the Customer at the time of the online order, by credit card or other suitable means. The tax documentation will be released by Beauty San SpA at the time of delivery. The issuing of the invoice must be requested in advance and the information provided by the Customer at the time of the order will prevail. No changes to the invoice will be possible after it has been issued.
To pay the price of the products and the related shipping and delivery costs you can follow one of the methods indicated in the order form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you. For the customer's safety, Beauty San SpA never becomes aware of the credit card number, this information is in fact received only by the banking circuit which must provide the payment authorization. It is the outcome of the transaction that is transmitted to us. No data relating to the credit card will therefore be transcribed on the documents relating to the order, nor stored within our systems or those of the express courier.
Art. 5 – Shipments
Deliveries take place exclusively on Italian territory excluding Livigno and Campione d'Italia via express courier and deliveries to post office boxes are not accepted.
Any shipping costs are highlighted in the order amount.
delivery generally takes place within 48 hours, throughout Italy except for disadvantaged locations and islands, from the moment the package is taken over by the express courier.
NB These times are those indicated by the express courier and therefore we cannot guarantee them, even if experience teaches us that they are almost always respected.
Delivery takes place from Monday to Friday during normal working hours.
In the event that the courier is unable to make the delivery due to the absence of the recipient, after two attempts he will leave a notice of attempted delivery with the details of the address to contact to arrange delivery.
Beauty San SpA will do everything possible to have the products delivered to the consumer within the indicated deadlines. The consumer is invited to contact ufficioclienti@moltonbrown.it in the event of a delay in delivery and in any case to report any inefficiency detected. Beauty San SpA is not responsible for delays that cannot be foreseen and/or are attributable to the Courier alone. In any case, except in cases of force majeure or unforeseeable circumstances, in accordance with article 54 of the Consumer Code the Products will be delivered within a maximum period of 30 (thirty) days starting from the day following the conclusion of the contract in compliance with the art. 2.
Art. 6 – Right of Withdrawal
The Customer has the right to withdraw from the contract, based on Legislative Decree 22 May 1999, n. 185, without any penalty and without specifying the reason, within 14 days of receipt of the goods, in accordance with correctness and good faith, upon written communication to be sent to: Beauty San SpA Via Rimini 37 - 59100 PRATO, ITALY also via email to servizioclienti@moltonbrown.it In the communication the Customer must indicate the product or products for which he intends to exercise the right of withdrawal, and more precisely the written communication must contain:
The expression of the desire to take advantage of the benefits granted by law.
The indication of the product purchased and which you wish to return.
In case of partial withdrawal, item code(s).
The data relating to the bank details on which to obtain the transfer (IBAN code - Buyer's current account).
The only costs that will be required will be shipping costs. The right of withdrawal applies only to goods intact at the time of return.
Beauty San SpA will reimburse it in accordance with the law in the ways and times agreed upon with the customer. Alternatively and only with the customer's consent, replacement with another product will be possible.
The right of withdrawal cannot be exercised if the product is not intact, that is:
- in the absence of the original packaging;
- in the absence of integral elements of the product (accessories, gifts, etc.);
- for damage to the product.
The right of withdrawal is reserved exclusively for consumers (natural persons who purchase the goods not for purposes related to their professional, commercial or entrepreneurial activity), therefore it cannot be exercised by legal entities and natural persons acting for purposes related to the activity professional activity possibly carried out.
The costs of returning the product are borne by the Customer.
Art. 7 – Return of damaged goods
In the event of delivery of an item damaged during transport, the Customer cannot bear the consequences, as all goods travel at our risk. In case of damage, however, we ask you to help us improve the service by accepting parcels with reserve.
Art. 8 – Guarantees and Responsibilities
Beauty San SpA, within the limits of availability as regulated above, guarantees that products identical to those indicated and described on the site will be delivered. Beauty San SpA guarantees the originality of the products.
The manufacturer's responsibility applies to all products sold. In the case of packaged products, the manufacturer is also responsible for the truthfulness and completeness of the information on the packaging. The images on the site are provided to the Customer to facilitate recognition of the products.

Art. 9 – Disputes and Applicable Law
Civil disputes relating to the application, execution and interpretation of the distance selling contract are subject to Italian jurisdiction and the Court of Florence will be competent. Remote contracts stipulated with Beauty San SpA are governed by Italian law and, although not expressly provided for, the relevant legal provisions apply.
